The petitioner has prayed for bail in connection with Shikarpur P.S. Case No. 356 of 2021 registered for the offence punishable under sections 302/120(B)/34 of the Indian Penal Code.

As per allegation in the FIR, while the son of the informant went to market for purchasing domestic goods, under a conspiracy, all accused persons on the order of Md. Shekh and Md. Murayan assaulted him by giving knife blow on his right side of chest. With help of villagers, he was taken to hospital where doctor declared his dead.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.13459 of 2022(3) dt.02-01-2023 2/2 that petitioner has been falsely implicated in this case due to old enmity. No specific allegation has been leveled against the petitioner. Postmortem report is not supporting the case of prosecution story. Petitioner is in custody since 11.10.2021. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Bettiah, West Champaran in connection with Shikarpur P.S. Case No. 356 of 2021.
