Petitioner seeks bail in connection with Govindpur P.S. Case No. 119 of 2016 registered for the offence under Sections- 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner and the alleged recovery is from the joint house. None of the member of the petitioner's family was present in the house, and as such, seizure list appears to be falsely prepared. Petitioner has no criminal antecedent and is in custody since 31.01.2017.

Considering the facts and circumstances of the

Patna High Court Cr.Misc. No.21568 of 2017 (2) dt.16-05-2017 2/2 case, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Govindpur P.S. Case No. 119 of 2016.
