JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-04-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 304/34 of the Indian Penal Code.
Informant alleged that due to illicit relation of the petitioner with his bhabhi, petitioner used to torture and harass informant's mother as a result of which she died. Learned counsel appearing for the petitioner submits that as a matter of fact, petitioner happens to be father of the informant, and deceased was wife of petitioner. Marriage had taken place 22 years back and out of the wedlock they had two sons, as such allegation of harassment and torture appear to be improbable. Doctor has not found any external or internal injury
Patna High Court CR. MISC. No.12314 of 2023(2) dt.28-04-2023 2/2 on the body of the deceased. Petitioner claims clean antecedent. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate I, Nalanda at Biharsharif in GR No.4805/2022, Silao Police Station Case No. 235/2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
