2. The petitioner seeks bail in a case registered for offence under Sections 191(2), 191(3), 190, 126(2), 115(2), 103(1) of the B.N.S., 2023.
3. As per prosecution case, on 25.08.2024, while the brother of informant was returning home after attending Panchaity, all the F.I.R. named accused persons including this petitioner came and assaulted him by means of Lathi and Garasa, as a result of which, the brother of informant died during treatment.
4. Learned counsel for the petitioner submits that from bare perusal of the F.I.R., it is apparent that altogether 11 persons have assaulted brother of informant, but in the post-
Patna High Court CR. MISC. No.12997 of 2025(3) dt.04-07-2025 2/2 mortem report, only three injuries have been found on the person of deceased, which itself belies the prosecution case. Allegation is general and omnibus and no specific overt act has been alleged against this petitioner. Petitioner is in custody since 25.09.2024. Chargesheet has been submitted.
5. Learned A.P.P. for the State vehemently opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jehanabad in connection with Kako P.S.
