The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341,323,448,379,380,427,302,504 and 506 of the Indian Penal Code.

It is alleged that co accused Pradeep Manjhi, Upendra Manjhi, Manoj Manjhi and petitioner no. 6 Nandlal Manjhi came to the shop of the informant and

Patna High Court Cr.Misc. No.9149 of 2016 (2) dt.29-02-2016 2/3 demanded cigarette, on refusal the accused persons came variously armed when the informant hid himself. Thereafter, the accused persons entered into the house of the brother of the informant and damaged the cycle, box and hand-pump. The brother of the informant took shelter in the house of Dularchand Manjhi when the accused persons dragged him out and co accused Upendra Manjhi caught the waist of the informant's brother and co accused Manoj Manjhi shot fire on the temporal region of the informant's brother and he succumbed to the injury. It is submitted by the learned counsel for the petitioners that the overt act of firing is only alleged against co accused Upendra Manjhi and Manoj Manjhi who are not petitioners before this court.

Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs.
