ANJANA MISHRA ORAL ORDER 31-08-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Section 498-A and other sections of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.
Earlier this matter had been referred to Patna High Court Mediation Centre. A report has been sent by the learned Mediator on 14.08.2015 stating that there has been a compromise between the parties and they have decided to live separately. In view of the fact that parties are not willing to pursue the case instituted against each other in the lower court as per the
Patna High Court Cr.Misc. No.10772 of 2015 (5) dt.31-08-2015 P2/2 compromise agreement dated 14.08.2015, present anticipatory bail application is disposed of.
Considering the fact that let the petitioner Shyamlendu Kumar, in the event of his arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Begusarai in connection with Complaint Case No. 339 C of 2013 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
