Petitioner seeks regular bail in Parwalpur P.S.Case No.178 of 2017 instituted for the offence under Sections 399, 402, 120(B) of I.P.C. and Sections 25(1-b)a, 26 and 35 of the Arms Act.

Allegation in brief is that police apprehended some miscreants after mid night and recovered arms from their possession and one country made pistol was recovered. Learned counsel for the petitioner submits that one country made pistol with a live cartridge is said to be recovered from possession of the petitioner and he has been languishing in

Patna High Court Cr.Misc. No.13143 of 2018 (2) dt.06-03-2018 2/2 custody for last 4 1⁄2 months and he has been made accused in other three cases subsequent to the present one. Learned counsel for the State submits that one case under Section 395 of I.P.C. was instituted prior to this case. Considering the aforesaid facts and circumstances, prayer for bail of the petitioner at present is rejected, however, petitioner may renew his prayer after framing of charge.
