This application has been filed for transfer of Matrimonial suit from the District of Purnea to District of Araria. There is specific provision for transfer under Section 24 of the Code of Civil Procedure. The petitioner has also leveled this application as an application under Section 24 CPC but since Article 227 is added, the application has been registered as writ application, in my opinion, since the petitioner has got statutory right under Section 24 of the CPC, the application should be registered as Misc. case.
The learned counsel for the petitioner seeks permission to delete the provision of Article 227 in the provision of law and then after deletion, the application may be registered as Misc. Jurisdiction Cases and it may be placed before appropriate Bench
