The petitioners have preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code.

As per the prosecution case, four accused persons on two motorcycles looted the informant of his mobile phone. It is submitted by learned counsel for the petitioners that the F.I.R. was registered against four unknown. The name of the petitioners transpired in course of investigation when they were arrested on the basis of the confessional statement of a co-accused in connection with Bidupur P.S. Case no.455 of 2018 and subsequently they were falsely implicated in the instant case. Inspite of being in custody in the instant case

Patna High Court CR. MISC. No.22284 of 2021(3) dt.16-11-2021 2/2 since 6.11.2020, they have not been put on T.I. parade nor any incriminating article has been recovered from their possession. Chargesheet has been submitted in the case.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioners having remained in custody for over 1 year, the Court directs the two petitioners to be enlarged on bail in connection with Bhagwanpur P.S. Case no.132 of 2018 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Vaishali at Hajipur.
