The petitioner has preferred this application for grant of regular bail in a case registered under sections 399 and 402 of the Indian Penal Code and sections 25(1-B)(a), 26 and 35 of the Arms Act.

As per the prosecution case, on the secret information about the accused persons having been received that they were planning to give effect to an occurrence, a raid was conducted. It is submitted that a number of accused persons including the petitioner herein were caught. Some drugs/charas, country-made katta loaded with cartridge was recovered from the other accused. From possession of the petitioner a mobile phone, an ATM card and a scanner machine was recovered.

No.22290 of 2021(2) dt.08-10-2021 2/2 It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the petitioner's possession who has been falsely implicated in the case. The petitioner was not caught at the alleged place of occurrence. He is in custody since 10.8.2020 and has been falsely implicated in the case because of his antecedents. Chargesheet has been submitted in the case.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over one year, the petitioner is directed to be enlarged on bail in connection with Muffasil P.S. Case no. 291 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya.
