JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Bhagwanpur Hat P.S. Case No. 46 of 2017, registered under Sections 272, 273 and 308 of the Indian Penal Code and Section 30(a) and 41(1) of the Bihar Prohibition and Excise Act, 2016. The accusation is that on search of a Scorpio vehicle, 35 Bottles of 375 ML and 70 bottles of 180 ML India made foreign liquor recovered. In course of investigation, it has come that the said vehicle was being driven by this petitioner. Learned counsel for the petitioner submits that petitioner has no criminal antecedent and he has falsely been implicated in this case mere on suspicion. The petitioner is in custody since 11.03.2017.

No.20979 of 2017 (2) dt.17-05-2017 2/2 Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-II, Siwan in connection with Bhagwanpur Hat P.S. Case No. 46 of 2017. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
