The petitioner seeks bail in connection with Kurhani P.S. Case No. 43 of 2017, registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.

The accusation is recovery of 16 bottles, each containing 180ML, 12 bottles each containing 180 ML and 25 bottles, each containing 375 ML India made foreign liquor from the possession of the petitioner.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent is in custody since 28.03.2017.

Having regard to the facts and the circumstances of

No.20984 of 2017 (2) dt.17-05-2017 2/2 the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Muzaffarpur in connection with Kurhani P.S. Case No. 43 of 2017. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
