The petitioner apprehends his arrest in connection with Sangrampur P.S. Case No.229 of 2021, registered for the offences punishable under Sections 406, 409 and 420 of the Indian Penal Code.

Accusation is of committing financial irregularities in the sell of fertilizer to the tune of Rs.7,85,498/-. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is submitted that petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that as per FIR, the petitioner is said to have committed financial irregularities of Rs.7,23,647/- and he is ready to return Rs.7,23,647/- to the concerned department in six installments.

Patna High Court CR. MISC. No.12426 of 2023(2) dt.28-04-2023 2/2 Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioner.

Taking into consideration the submission made by learned counsel for the petitioner that the petitioner is ready to return Rs.7,23,647/- to BISCOMAUN, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on provisional bail for a period of eight months on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-I, Munger in connection with Sangrampur P.S. Case No.229 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. It is made clear that the learned court below shall confirm the bail bond of the petitioner after verifying the fact that petitioner has already returned Rs.7,23,647/- to BISCOMAUN in six installments.

Accordingly, this anticipatory bail application is disposed of.
