JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 26-08-2015 The petitioner has filed the present MJC application raising a grievance that the order dated 21.07.2014 passed in CWJC No.3518 of 2014, as contained in Annexure-1, is not being complied with by the opposite party concerned. A show cause has been filed on behalf of the opposite party no.3 stating therein that, in compliance of the order of this Court, the representation filed on behalf of the petitioner was considered and finally disposed of by the order dated 17.04.2015, as contained in Annexure-A to the show cause.

In view of the aforesaid facts, this Court is satisfied that no case for initiation of contempt proceeding is made out. However, the petitioner shall be at liberty to assail the validity and correctness of the aforesaid order dated 17.04.2015 passed by the District Magistrate, Muzaffarpur (Annexure-A to the aforesaid show cause) before an appropriate forum/court.

Patna High Court MJC No.887 of 2015 (2) dt.26-08-2015 application stands disposed of as infructuous, but with the liberty given above.
