This application is for grant of regular bail in connection with Sour Bazar P.S.Case No.344 of 2016 (G.R.No.2280 of 2016) for the offences under Sections 341, 323, 379, 309, 385, 504 & 506/34 of the Indian Penal Code.
Allegation against the petitioner and others is about assault on the informant.
It is submitted on behalf of the petitioner that the other accused persons have already been granted anticipatory bail by this Court and the petitioner is in custody since 22.02.2017. There is instruction that the parties have compromised the case. Heard learned A.P.P. also, who has opposed the prayer for bail.
Patna High Court Cr.Misc. No.21898 of 2017 (2) dt.10-05-2017 2/2 Having heard both sides and in view of allegation and nature of injury, I am not inclined to grant bail to the petitioner, however, considering submission of the learned counsel for the petitioner that the parties have compromised the case, the learned trial court is directed to expedite the trial and once the informant and the injured are examined during the trial, the petitioner may renew his prayer for bail before the court concerned itself, who will pass appropriate order on the basis of materials available on the record.
With the aforesaid observation, this application is dismissed.
