The petitioner seeks pre-arrest bail in connection with Jamui Mahila P.S. Case No. 57 of 2014 registered for the offences punishable under sections 420, 409, 468, 467, 471 and 120-B of the Indian Penal Code.
It is contended that the case of the petitioner stands on better footing to that of the case of co-accused Umesh Kumar Singh and Binod Kumar, who have already been granted prearrest bail by this Court vide orders dated 03.07.2015 passed in Cr.Misc. No. 1187 of 2015 and Cr. Misc. No. 18645 of 2015 respectively.
Learned counsel for the State does not dispute the
Patna High Court Cr.Misc. No.15973 of 2015 (3) dt.02-09-2015 2/2 fact that two other co-accused having more or less identical allegations have already been granted pre-arrest bail by this Court. Regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within four weeks from today, the petitioner Rajesh Kumar @ Rajesh Kumar Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Jamui in connection with Jamui Mahila P.S. Case No. 57 of 2014, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
