The petitioner apprehends his arrest in connection with Baligaon P.S. Case No.91 of 2019, registered for the offences punishable under Sections 147, 148, 323, 324, 325, 307, 153(A), 295 and 427 of the Indian Penal Code. The petitioner is said to have assaulted the informant by means of sword causing cut injury. The accused persons thereafter started pelting stones on the house of the informant due to which the niece of the informant sustained injury. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Patna High Court CR. MISC. No.13634 of 2022(2) dt.04-08-2022 2/2 enlarged on anticipatory bail vide order dated 08.10.2020, passed in Cr. Misc. No.24878 of 2020 and order dated 08.03.2021, passed in Cr. Misc. No.34436 of 2020 by different co-ordinate Benches of this Court.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioner and submitted that the petitioner has got one criminal antecedent.

Considering the fact similarly situated other coaccused persons have already been enlarged on anticipatory bail by different co-ordinate Benches of this Court, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Baligaon P.S. Case No.91 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
