JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-02-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 504 of the Indian Penal Code and Section 3(1)(x) SC/ST (Prevention of Atrocities )Act.
It is alleged that the petitioner being a teacher in a school took the photograph and voter I.D. of Smt.Dhania Devi,the Secretary of Siksha Samittee of the said school but not returning the same. The petitioner abused and assaulted the informant, a teacher in the same school and Dhania Devi for asking to return voted I.D. and photograph.
It is submitted by learned counsel for the petitioner that due to school politics the petitioner has been roped in the
Patna High Court Cr.Misc. No.7238 of 2015 (2) dt.23-02-2015 2/2 present case. The mater has been compromised between the parties, An application to that effect has been filed before the learned court below.
Considering the above facts, let the above named petitioner be released on anticipatory bail , in the event of arrear or surrender before the learned court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Begusarai in Begusarai (Sadar) SC/ST P.S.Case No.42 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
