Trial court has reported that out of nine proposed witnesses, five witnesses have already been examined and for procuring the attendance of remaining prosecution witnesses, processes have already been issued. Trial court has given explanation in respect of the delay of trial and also assured this court that trial of the petitioner shall be concluded within three months.
In view of the report of the trial court as well as facts and circumstances of the case, I am not inclined to release the petitioner on bail and, again, his prayer for bail in connection with Session trial no. 58/2016 arising out of Mufassil P.S. Case no. 189/2014 pending in the court of Addl. Sessions Judge I, Munger stands rejected. Let copy of this order be sent to Superintendent of Police, Munger with direction to him to ensure the presence of remaining
Patna High Court Cr.Misc. No.19571 of 2017 (3) dt.19-07-2017 prosecution witnesses before the trial court. It is made clear that if prosecution fails to produce witnesses and the trial court fails to conclude trial of the petitioner within the period as fixed by the trial court itself, petitioner may renew his payer for bail before the trial court itself.
