JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 08-05-2015 The petitioner, who is father-in-law of the victim girl, has renewed his prayer for anticipatory bail in a case under section 498A, 306/34 of the Indian penal Code.
Earlier, the petitioner along with his wife has prayed for grant of anticipatory bail. While granting anticipatory bail to the petitioner's wife Meena Devi, this Court disposed of the anticipatory bail application of the petitioner with an observation to surrender and pray for regular bail which would be disposed of without prejudice.
The petitioner submits that the matter between the parties has been compromised and both of them have filed compromise petition which fact is not disputed by learned counsel for the informant.
In the circumstances, the appropriate course for the
Patna High Court Cr.Misc. No.16498 of 2015 (2) dt.08-05-2015 petitioner would be to surrender in the court below and bring all these points before the court concerned which would be considered on its own merit.
With the aforesaid observations and directions, this writ application stands disposed of.
