Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in connection with Mahua P.S. Case No.569 of 2020, registered for the offences punishable under Sections 30(a)/32(ii)/34(ii)/ 38(ii) /41 (i) of the Bihar Prohibition and Excise Act. Huge quantity of liquor was recovered from the fodder house of the petitioner. The petitioner has got one identical criminal antecedent.

Considering presumption of law against the petitioner as contained in Section 32 of the Bihar Prohibition and Excise Act as well as bar of prayer for anticipatory bail under Section

Patna High Court CR. MISC. No.21690 of 2021(2) dt.30-11-2021 2/2 76(2) of the said Act, I am not inclined to grant anticipatory bail to the petitioner. Hence, the prayer for anticipatory bail is refused. However, in the event of surrender of the petitioner within four weeks, the prayer for regular bail shall be considered without being prejudiced by the order of this Court.
