1. Heard learned counsel for the petitioner, learned Counsel for the Opposite Party No. 2 and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Complaint Case No. 1485 of 2022 for the offences punishable under Sections 498(A) of the Indian Penal Code.
3. The petitioner is the husband of the Opposite Party No. 2. The marriage between them was solemnized on 27.06.2020 as per Hindu rites. At the time of marriage Rs. 4,00,000/- in cash and gift worth of Rs. 4,00,000/- in form

The allegation is that the husband, along with other family members, after marriage, started demanding Rs. 10,00,000/- cash as dowry and due to non-fulfillment of the said demand, the Opposite Party No. 2-wife was tortured, both mentally and physically and finally ousted her from matrimonial home while she was three months pregnant. It has further been alleged that a panchayati was held, but failed and at the time the opposite party no. 2 gave birth to her female child no one cared to come.
4. Earlier, the matter was referred to mediation centre by this Court vide its order, dated 20.05.2025.

Learned counsel for the petitioner submits that the mediation has been successful and both the parties have resolved their disputes through process of mediation in accordance with the terms of settlement, mutually arrived at by the parties, having been recorded in the mediation report, dated 10.07.2025, passed in Mediation Proceeding No. 806 of 2025.
6. Considering the submissions advanced by the parties and taking into consideration the terms of settlement arrived at between them in mediation and in the interest of both

No.13201 of 2025(4) dt.20-08-2025 3/3 the husband and the wife, I am inclined to grant the petitioner privilege of anticipatory bail, subject to condition that the petitioner shall abide by the terms and condition of the settlement, arrived at and signed by both the parties in mediation
7. With the aforesaid observations and direction, this application is allowed.
8. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate First Class, Nawada, in connection with Complaint Case No. 1485 of 2022, subject to the condition that the petitioner shall strictly abide by the terms and condition of the agreement, dated 10.07.2025.
