The petitioner is accused in connection with Kumarkhand P.S. Case No. 53 of 2017 registered for the offences under Sections 37 (c) and 38 (1) of the Bihar Prohibition and Excise Act, 2016.
The accusation is that in course of checking the vehicles by the police, the petitioner was found in drunken state having a bottle, containing one litre country-made liquor, in his hand.
Learned counsel appearing on behalf of the petitioner submits that the petitioner having no criminal antecedent, is in custody since 11.03.2017 .
Patna High Court Cr.Misc. No.21006 of 2017 (2) dt.12-05-2017 2/2 Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Madhepura in connection with Kumarkhand P.S. Case No. 53 of 2017, subject to the condition that out of two sureties, one surety must be the close relative of the petitioner.
