The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code.

Prosecution case is that daughter of the informant went missing on 24.10.2015, leading to registration of the present case. In 164 Cr.P.C. statement the victim got her age recorded as 19 years when the learned court below also assessed as such wherein she has stated that her uncle wanted to take some illegal favour when the victim went with Vikash Sharma and has performed marriage with him in a temple.

It is submitted by learned counsel for the petitioners

Patna High Court Cr.Misc. No.9218 of 2016 (2) dt.29-02-2016 2/2 that petitioner nos. 1 and 2 are relative of Vikash Sharma when petitioner nos. 3 and 4 are neighbor of the informant. The victim has not named these petitioners in her statement recorded under section 164 Cr.P.C..

Considering 164 Cr.P.C. statement of the victim girl, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Dalsingsarai, Samastipur, in connection with Vidyapati Nagar P.S. Case No.148/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
