The petitioners seek bail in connection with Khanpur P.S. Case No. 11 of 2017, registered under Section 302 of the Indian Penal Code.

Learned counsel for the petitioners submits that it would appear from the F.I.R. that regarding the death of Md. Kasim, Khanpur P.S. Case No. 11 of 2017, registered under Section 302 of the Indian Penal Code against unknown on the basis of written report of Md. Edrish Kha, who is admittedly father in law of petitioner No.3 and petitioner No.1 and 2 are father and brother of petitioner No.3 and due to matrimonial

Patna High Court Cr.Misc. No.20994 of 2017 (2) dt.17-05-2017 2/2 dispute in between petitioner No.3 with his wife Sajda Khatoon, daughter of the deceased. The wife of petitioner No.3 Sajda Khatoon, her mother and son gave her statement under Section 164 Cr.P.C. only raising suspicion against the petitioners having hand in the murder of deceased. The petitioners have no criminal antecedent and they are in custody since 31.01.2017. Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the ACJM-III, Samastipur in connection with Khanpur P.S. Case No. 11 of 2017.
