JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Palanwa P.S. Case No. 21 of 2014 registered for the offences punishable under Sections 341, 323, 324, 307, 379/34 of the Indian Penal Code.
Altogether, three persons sustained injury in the alleged occurrence though it is stated that they sustained simple injury and the matter has already been compromised but considering the facts and circumstances of the case as well as submissions of the parties, I am not inclined to grant the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Palanwa P.S. Case No. 21 of
Patna High Court Cr.Misc. No.11976 of 2015 (2) dt.31-03-2015 2014 pending in the court of Sub Divisional Judicial Magistrate, Raxaul at Motihari, East Champaran stands rejected. However, it is made clear that if petitioner surrenders before the concerned court within four weeks from today and seeks regular bail, the concerned court shall consider the regular bail application of the petitioner on its own merit without being prejudiced by this rejection order, particularly, keeping in mind the allegation levelled against the petitioner, nature of injury sustained by the injured as well as factum of compromise.
