JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 16-05-2023 Heard the learned Senior counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Saraiya P.S. Case No. 727 of 2021, registered for the offences punishable under Sections 272, 273, 284, 328, 307, 302/34 and 120B of the Indian Penal Code and Sections 30(a)/30(c)/37(b) of Bihar Prohibition and Excise Act 2016. The allegation against the petitioner is that he along with other co-accused persons was involved in the manufacturing of illicit liquor and after consumption, some deaths were caused.

The learned Senior counsel for the petitioner has

Patna High Court CR. MISC. No.13291 of 2023(2) dt.16-05-2023 2/2 submitted that petitioner is innocent and has falsely been implicated in this case and nothing has been found against him in course of investigation and on exactly similar footing, other co-accused persons have been granted bail by the co-ordinate Benches of this Court in Criminal Miscellaneous Nos. 8083, 41988, 6891 and 67212 of 2022.

On the other hand, the learned APP has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court No. II, Muzaffarpur in connection with Saraiya P.S. Case No. 727 of 2021, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
