JUSTICE MOHIT KUMAR SHAH ORAL ORDER 27-02-2019 The present modification petition has been filed for extending the time granted for surrendering before the learned trial court for the purposes of being released on anticipatory bail as was granted vide order dated 15.01.2018 passed in Criminal Miscellaneous No. 49283 of 2017.
The learned counsel for the petitioner submits that the petitioner, being a labourer, was residing outside the State of Bihar for his livelihood, hence, some delay has taken place in returning back, hence, he be granted some more time to surrender before the learned trial court.
Considering the submissions made by the learned
Patna High Court CR. MISC. No.10931 of 2019(2) dt.27-02-2019 2/2 counsel for the petitioner as also considering the averments made in the present petition, the present modification petition is allowed and the petitioner is granted further four weeks' time to surrender before the learned trial court for the purposes of grant of anticipatory bail in terms of the order dated 15.01.2018 passed in Criminal Miscellaneous No. 49283 of 2017. The present modification petition is disposed of on the aforesaid terms.
