The petitioner is languishing in custody for the offences punishable under Sections 399/402 of the Indian Penal Code and Sections 25(1-b)a/26/35 of the Arms Act. The petitioner is in custody since 29.05.2017. A country-made pistol was allegedly recovered from the possession of the petitioner. Similarly situated co-accused Jai Prakash Yadav @ Karu has already allowed bail by a coordinate Bench of this Court in Cr. Misc. No.47764 of 2017.
Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like
Patna High Court Cr.Misc. No.12943 of 2018 (2) dt.07-03-2018 P2/ amount each to the satisfaction of the learned Court-below where the case is pending in connection with Jhajha P.S. Case No.137 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
