Petitioners apprehend arrest in a case registered for the offence punishable under Section 30a of the Bihar Prohibition and Excise Act.

Prosecution case is that 25 liters country made liquor was recovered behind the house of one Bans Narain Singh. Learned counsel appearing for the petitioner submits that no incriminating material has been recovered from the conscious possession of the petitioners and they are no way connected with the aforesaid recovery. Petitioners have got no criminal antecedent of similar nature.

Considering the facts of the case, this pre-arrest bail

In the event of arrest/surrender within six weeks from today, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Exclusive Special Excise Court No. 1 cum Additional Sessions Judge II, Rohtas at Sasaram in Darihat Police Station Case No. 233 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
