The petitioner seeks bail in a case registered under Section 304/34 of the Indian Penal Code.

Allegation against the petitioner is that on the pretext of getting operated from the doctor, he along with other co-accused operated informant's sister, as a result of which, she died. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 06-11-2018. Charge sheet has already been submitted. The petitioner has been falsely implicated in the present case. The petitioner is alleged to be compounder of the doctor. He has been made accused in the

Patna High Court CR. MISC. No.11875 of 2019(3) dt.11-04-2019 2/2 present case due to mistake of fact. Specific allegation is against co-accused Dr. Sanjeet who is alleged to have operated upon the deceased. The other co-accused namely Awadh Paswan with similar allegation have been granted bail by a coordinate bench of this court vide order dated 06-03-2019 passed in Cr. Misc. No. 5529 of 2019.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Atri P.S. Case No. 266 of 2018.
