Patna High Court CR. MISC. No.11430 of 2020(2) dt.25-06-2020 2/3 Heard learned counsel for the petitioners and counsel for the State.

The petitioners apprehend their arrest in Bairgania P.S. Case No. 235 of 2019, registered for the offence punishable under Section 147, 148 and other allied sections of the I.P.C. Prosecution case, in brief, is that when the police officers were on duty and trying to maintain law and order situation created due to altercation between people of two villages. These petitioners armed with lathi, danda and stone attacked the police force also, causing them injuries. Learned counsel for the petitioner submits that though petitioners are named in the FIR no specific allegation has been attributed against them. Petitioners have got no criminal antecedent. Similarly situated co-accused mentioned in Para. 13 of the bail petition have already been allowed anticipatory bail by different Bench of this Court.

Considering the facts aforesaid, the petitioners abovenamed in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the
