JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-05-2019 This application, for grant of anticipatory bail, arises out of Chandauti P.S. Case No. 254/18, disclosing offences under Sections 420, 467, 468, 471, 120(B) of the Indian Penal Code.

Petitioners are Prakhand Teacher and allegation against them is that they conspired with other co-accused persons and got their merit marks increased and on the basis of the same, they secured the appointment as Prakhand Teachers. Submission of learned counsel for the petitioners is that there is no allegation that the certificates of the petitioners have been found forged and further the merit marks is prepared by the committee and not by the petitioners and petitioners have

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Chandauti P.S. Case No. 254/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. It is made clear that the grant of this anticipatory bail to the petitioners does not debar the authorities to take departmental action against the petitioners.
