Petitioners, already in custody, seek bail in connection with Hilsa P.S. Case No.21 of 2018, registered under Section 379 of the Indian Penal Code, Sections 4/40 of the Bihar Minor Mineral Concession Rules, 1972 as well as under Rule 8 of the Bihar Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2003.

Learned counsel for the petitioners submits that the sand was loaded by some other person, petitioners are owner and driver of the tractor, both are in custody since 16.01.2018 and petitioner no.1 has no criminal antecedent and petitioner no.2

Patna High Court Cr.Misc. No.13355 of 2018(2) dt.07-03-2018 2/2 has two criminal antecedents on which he is on bail. Having considered the said facts and circumstances, petitioners, namely, Sanveer Kumar and Pintu Kumar are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-1, Hilsa (Nalanda) in connection with Hilsa P.S.
