JUSTICE SHIVAJI PANDEY ORAL ORDER 22-07-2020 Heard learned counsel for the petitioner and learned APP for the State through virtual Court proceeding. In this case, the petitioner is seeking anticipatory bail in connection with Kalyanpur P.S. Case No. 293 of 2019, registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.

Allegation has been made that about 6 liters of country made liquor has been recovered from the bag of the petitioner.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent.

Looking to the quantum of liquor recovered from the bag of the petitioner as also the fact that the petitioner has no criminal antecedent, let the above-named petitioner be released

Patna High Court CR. MISC. No.12370 of 2020(2) dt.22-07-2020 2/2 on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the 9th Additional Sessions Judge-cum-Special Judge, Excise, Motihari, East Champaran, in connection with Kalyanpur P.S. Case No. 293 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. This is also subject to the condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases, then the concerned Court below would be at liberty to take steps for cancellation of his bail bonds.
