JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 19.07.2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner is in jail custody since 15.5.2015 and earlier his prayer for bail was rejected by this court vide order dated 8.3.2016 passed in Cr. Misc. no. 10701/2016.

The report of the Addl. Sessions Judge VIII, Rohtas at Sasaram show that charge against the petitioner was framed on 25.5.2016 but up till now, only three prosecution witnesses out of 11 prosecution witnesses could be examined. Therefore, it appears from the report of the Addl. Sessions Judge that there is no possibility of conclusion of trial of the petitioner in near future. No doubt, petitioner carries some criminal antecedent but submission on behalf of the petitioner is that in almost all cases either he has been acquitted or granted bail.

Considering the aforesaid facts and circumstances as well as

No.21312 of 2017 (3) dt.19-07-2017 submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Rohtas at Sasaram in Sessions trial no. 530/2015 arising out of Sasaram (Mufassil) P.S. Case no. 547/2015.
