====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 22-03-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Sonbarsa P.S. Case No. 160 of 2020 instituted for the offences under Sections 272, 273 of the Indian Penal Code read with Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

This is the second attempt of the petitioner as his bail application was earlier rejected by order dated 12.07.2021 passed in Cr. Misc. No. 15930 of 2021 with an observation that if the trial is not concluded within six months the petitioner would be at liberty to renew his prayer for bail before the learned curt below itself.

Learned counsel further submits that charges have been framed but the trial has not commenced.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted and the charges have been framed, let the petitioner above named be released on bail on furnishing bail bond of Rs.2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II-cum-Special Excise Court No. 1, Sitamarhi in connection with Sonbarsa P.S. Case No. 160 of 2020.
