2. The petitioner has preferred this application for grant of regular bail in connection with Town (Motihari) P.S. Case No. 599 of 2024, registered for the offences punishable under Sections 309 (4) of the B.N.S. and sections 25(1-B) (a), 27 and 35 of the Arms Act.
3. As per the prosecution story, on the alleged date of occurrence, the petitioner and other accused persons have allegedly snatched Rs. 1,15,000/- from the informant on the point of pistol and knife.
4. Learned counsel for the petitioner submit that
Patna High Court CR. MISC. No.11976 of 2025(3) dt.12-05-2025 2/3 petitioner is innocent and has falsely been implicated in this case. The name of the petitioner has transpired on the basis of confessional statement of co-accused persons. No incriminating material has been recovered from the conscious possession of the petitioner. No TIP has been conducted in this case and after completion of investigation, charge-sheet has been submitted against the petitioner. The petitioner is in custody since 24.10.2024.
5. Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.
6. Keeping in view the aforesaid facts and considering the period under custody, let the petitioner, above named, be released on bail after framing of charge, if charge not framed on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Town (Motihari) P.S. Case No. 599 of 2024, subject to the following conditions :- (i). One of the bailors should be close relative of the petitioner.
(ii). Petitioner shall co-operate in the trial and shall be present on each and every fixed date and on his absence on two
Patna High Court CR. MISC. No.11976 of 2025(3) dt.12-05-2025 3/3 consecutive dates without sufficient reason, their bail bonds may be cancelled by the learned Trial Court.
