31-03-2016 Heard learned counsel for the petitioner and Sri Mayanand Jha, learned Addl. Public Prosecutor. The petitioner, invoking inherent jurisdiction of this Court under Section 482 of the Code of Criminal Procedure, has prayed for quashing of an order dated 06-03-2013 passed by learned Chief Judicial Magistrate, Katihar in Katihar (Sahayak) P.S. Case No. 548 of 2011. By the said order, after submission of chargesheet, whereby, the petitioner was shown as accused in column no. 11 in the chargesheet, the learned Magistrate has taken cognizance of the offence under Sections 419, 420, 467, 468, 471, 120(B) of the Indian Penal Code.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.24521 of 2013 (3) dt.31-03-2016 2/2 informant of the present case had also filed a complaint case and on this ground, he has made a prayer for quashing of the order of cognizance.

After examining the material on record, particularly the fact that police has already submitted chargesheet and there is no apparent error in the order of cognizance, I do not find any ground to entertain the petition.

The petition stands dismissed.
