This application for anticipatory bail arises out of Rosera P.S. Case No. 275 of 2018 for the offence under Sections 323, 341, 379, 384, 447, 504 and 506/34 of the Indian Penal Code.

It appears from the case of the prosecution that there is already a land dispute between the informant and the persons accused. The occurrence is said to have taken place when the informant was in the process of getting a boundary wall constructed over the said land. Allegedly, the accused persons are said to have forcibly stopped the informant from raising the boundary wall. There is allegation of assault and demand of extortion money.

Considering the nature of accusation, this

Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st, Rosera, Samastipur, in Rosera P.S. Case No. 275 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
