The petitioner, who is in custody, seeks bail in connection with Session Case No. 320 of 2017 arising out of Sasaram Town (Darigaon) P.S. Case No. 362 of 2017 registered for the offence punishable under Section 392 of the I.P.C. The FIR has been lodged on the basis of fardbeyan of the informant in which he has stated that he alongwith truck cleaner proceeded to Barun to load sand. It has further alleged that an another truck with driver and cleaner both proceeded together to load sand. At about 10.45 when they reached near the Beda bridge on N.H.2, all of sudden tyre of both trucks became puncture then they were changing tyre of their respective truck. In the meantime four persons arrived
Patna High Court Cr.Misc. No.14249 of 2018(3) dt.05-04-2018 2/2 there and on point of Katta they snatched Rs. 30,000/- from the informant and 18000/- from another driver and mobile phone and fled away.
It has been submitted that petitioner is not named in the FIR and he is innocent and has been falsely implicated in this case. It has further been submitted that co-accused namely, Mahabir Yadav has already been granted bail by a co-ordinate Bench of this Court vide order dated 09.02.2018 passed in Criminal Misc. No. 8070 of 2018 and petitioner is in custody since 02.08.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District & Sessions Judge-4th, Rohtas at Sasaram, in connection with Session Case No. 320 of 2017 arising out of Sasaram Town (Darigaon) P.S. Case No. 362 of 2017 (S. Kumar, J) veena/- U T
