The petitioner seeks bail in Sessions Trial No. 142/2000/238/14, arising out of Nabinagar P.S. Case No. 48 of 1999 registered for the offences punishable under Section 302, 149 and other Sections of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner was on bail but his bail bond was cancelled on 07.07.2009. The petitioner surrendered in the court on 27.01.2017 and since then he is in jail. It is further submitted that the petitioner had gone out of his village to earn his livelihood and due to non-attendance his bail bond has been cancelled. The petitioner has already remained in jail for more than three months for misuse of privilege of bail.
Patna High Court Cr.Misc. No.21109 of 2017 (2) dt.04-05-2017 2/2 Considering the facts aforesaid the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-III, Aurangabd in Sessions Trial No. 142/2000/238/14, arising out of Nabinagar P.S. Case No. 48 of 1999.
