JUSTICE ARUN KUMAR ORAL ORDER 08-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Phulwaria PS Case No. 111 of 2017 registered under Sections 395 and 397 of the IPC.

The allegation in brief is that while the informant was carrying twenty lakh rupees from Bank of India Branch from Barauni to Alapur branch, on way motorcycle borne criminals on the point of pistol looted the money and escaped away. Learned Counsel for the petitioner submits that the FIR is against unknown, only on the basis of confessional statement of one Pankaj Kumar disclosing his name as one of the accomplice there is no other material, the money was recovered on the disclosure of Pankaj Kumar and neither anything has been recovered from the possession of the petitioner nor he was put on TIP. Having considered the said facts and circumstances, the petitioner, namely, Pintoo Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Raghubir Prasad, Judicial Magistrate, lst Class, Begusarai in connection with Phulwaria PS Case No. 111 of 2017.

Patna High Court Cr.Misc. No.13666 of 2018 (2) dt.08-03-2018 The petitioner is directed to appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
