The petitioner seeks bail in Bidupur P.S. Case No.368 of 2019, G.R. Case No.5311 of 2019 registered under Sections 399, 402, 413 and 414 of the Indian Penal Code and under Sections 25(1-b)a, 26 and 35 of the Arms Act. The police on secret information that 4-5 criminals on two motorcycles were going towards Bidupur station for committing crime, a raid was conducted. Three persons namely, Kunal Kumar, Nitish Kumar and Sunny Kumar were apprehended and from their possession, arms and ammunition were recovered. The apprehended accused disclosed that the leader of their gang are Sushil Kumar and Sujeet Kumar and on raid in the house of the petitioner from the pocket of the petitioner, one mobile was recovered. Patna High Court CR. MISC. No.10719 of 2020(2) dt.28-02-2020 2/2 stands in the name of Sushil Kumar, the brother of the petitioner was recovered. No incriminating articles either arms and ammunition or any stolen article was recovered from the possession of the petitioner. Petitioner is in jail since 20.09.2019.
Considering the fact that nothing incriminating article has been recovered from the possession of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S.
