JUSTICE SANJAY PRIYA ORAL ORDER 17-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Mokama P.S. Case No. 13 of 2017 instituted for the offence under Sections 414, 465, 468, 471 and 34 of the Indian Penal Code.
It has been submitted that the petitioner was not present in car which was recovered by the police. As per allegation, two persons were found sitting in the car namely, Sanjeet Kumar and Shivji Singh. The name of this petitioner has been disclosed by co-accused Sanjeet Kumar in his confessional statement which also finds mention in the impugned order. It is mentioned in paragraph-3 of the bail petition that petitioner has no criminal antecedent.
Considering the aforesaid facts and circumstances of
Patna High Court Cr.Misc. No.21731 of 2017 (2) dt.17-05-2017 2/2 the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri D. Kumar, learned Sub Judge IVth cum A.C.J.M. Barh, Distt. Patna, in connection with Mokama P.S.
