JUSTICE ARUN KUMAR ORAL ORDER 08-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Raghopur PS Case No. 127 of 2017 registered under Sections 363, 365, 366A, 506 and 34 of the IPC.

Learned Counsel for the petitioner submits that both sides are neighbours, due to dispute relating to construction he has been falsely implicated, the girl herself returned back next morning aqnd she has stated in her statement that she was left by the accused persons in the forest and they returned back. The allegation is said to be of 11 in the night of 13th but the case was lodged next day at 11 AM but before that the girl is said to have returned back. The petitioner has no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Dheeraj Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM IV Vaishali at Hajipur in connection with Raghopur PS Case No. 127 of 2017.
