The petitioner seeks bail in a case registered under Section 304 of the Indian Penal Code.

Allegation is that on 6.9.2018 the sons of the informant, namely, Rajiv Kumar and Ranjeet Kumar exchanged hot words and the petitioner pierced screw driver in neck of Ranjeet Kumar. Thereafter blood started oozing out from his neck and he became unconscious and then he died.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 8.9.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the

Patna High Court CR. MISC. No.11768 of 2019(3) dt.09-04-2019 2/2 petitioner. The petitioner had no intention to commit the alleged offence. No deadly weapon is alleged to have been used in course of occurrence. For a petty reason the alleged occurrence is said to have taken place.

On behalf of the State, it is submitted that the petitioner is named in the complaint case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Sheohar in connection with Triyani Chapra P.S. case No.72 of 2018.
