JUSTICE SANJAY PRIYA ORAL ORDER 10-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Katoria P.S. Case No. 136 of 2015 instituted for the offence under Section-307, 325 & other minor sections of the Indian Penal Code.
It has been submitted that the occurrence took place on account of land dispute. There is case and counter case between the parties. The petitioner has lodged Katoria P.S. Case No. 135 of 2015, in which, the petitioner and his mother sustained injury. The injury report of the petitioner has been annexed as Annexure-3 to this petition.
There is allegation against the petitioner of assaulting Jaykant with iron rod. From the injury report of Jay Kant Dhaur, it appears that the doctor has found bleeding injury. In the
Patna High Court Cr.Misc. No.21622 of 2017 (2) dt.10-05-2017 supplementary injury report of Jaykant, injury was found to be grievous. As per injury report of Jaykant, there is no repetition of blow. There is case and counter case between the parties. The petitioner has also sustained injury in the said occurrence. In such circumstances, the prayer for bail is allowed and the petitioners named above, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Katoria P.S. Case No. 136 of 2015 to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Banka subject to condition that both the bailors should be close relatives of the petitioner.
