The petitioners seek bail in Muzaffarpur P.S. Case No.08 of 2018 registered under Section 272 & 273 of the Indian Penal Code and Section 30 (a), 38 (2), 41 (1) & 47 of the Bihar Prohibition and Excise Act, 2016.

137.92 liters of foreign liquor is said to have been recovered from the house of one Panditjee and petitioners were apprehended.

No.13352 of 2018 (02) dt.07-03-2018 2/ 2 It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioners. The petitioners happen to be tenant of the said house and have no concern with the seized liquor. They have been falsely implicated in this case at the instance of their enemies. They have no criminal antecedent. They have been languishing in custody since 06.01.2018. In the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Muzaffarpur in connection with Muzaffarpur Town P.S. Case No.08 of 2018.
