====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 21-07-2025 Heard learned counsel for the petitioner and learned A.P.P for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Dumra P.S. Case No. 271 of 2023 dated 02.06.2023 registered for the offences punishable under Section 392 of the Indian Penal Code.

As per the prosecution case, four miscreants are alleged to have entered in Bandhan Bank and on the point of pistol, Rs. 11,57,078/- in cash, three tabs and one mobile of the informant were looted by them and thereafter they fled away on a motorcycle. Hence, the F.I.R. was lodged against four unknown persons.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.14340 of 2025(2) dt.21-07-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R. The name of the petitioner has sprung up during the course of investigation on the basis of the confessional statement of the co-accused. The petitioiner has been remanded in the present case from Dumra P.S. Case No. 283 of 2023. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged offence. No T.I.P. has been conducted by the prosecution. It is further submitted that the amount of Rs. 1,26,000/- recovered from the house of the petitioner which belongs to the father of the petitioner which was withdrawn by his father on 19.05.2023 and Rs. 49,900/- was withdrawn on 05.06.2023.

It is further submitted that the father of the petitioner sold 07 decimals of land to one Kiran Devi for a consideration money of Rs. 2,85,000/- on 22.02.2022 and the said money was deposited in the bank. It is further submitted that the co-accused person, Indal Mahto, has already been granted bail by a Co-ordinate Bench of this Court vide order dated 25.03.2025 passed in Cr. Misc. No. 7407 of 2025. The petitioner has nine (09) criminal antecedents and in eight cases, he is on bail as stated in para 3 of the bail petition. The petitioner is in custody since 07.06.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-II, Sitamarhi in connection with Dumra P.S. Case No. 271 of 2023 with further condition :- (I) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
